Our estate and trust attorneys regularly serve as outside counsel to local, regional, and national corporate and institutional trustees, assisting with thorny Maryland and District of Columbia trust cases. Our planning background gives us familiarity with the circumstances under which corporate trustees are commonly appointed. We marry extensive knowledge of local codifications of the Uniform Trust Code with nuanced knowledge of how our local courts process cases. When possible, we work via non-judicial settlement agreement (NJSA), but we are comfortable presenting estate and trust matters to our local courts and explaining complicated estate and trust matters to the court. Our unique skill set allows us to provide advice to most efficiently resolve an issue, while offering the protection that the trustee requires and deserves.
Representative matters include:
- Providing general advice and guidance to the trustee on local procedure and compliance with local codifications of the Uniform Trust Code;
- Communicating with beneficiaries on behalf of the trustee to determine whether an NJSA will be possible, or if judicial intervention will be required;
- Negotiating and drafting NJSAs on a wide variety of trust matters;
- Petitioning for judicial modification of charitable and non-charitable trusts;
- Petitioning for judicial approval of trust terminations;
- Representing the trustee in local court proceedings and court-ordered mediation;
- Securing judicial approval of final trust accountings;
- Securing judicial approval of the appointment of successor trustees and co-trustees where NJSAs were not practicable
